THIEVES AND LIARS!

When our house burned down in 2007, our mortgage was with this company. The insurance company issued the first portion of our rebuild money to this company. We were living in a hotel room... My mother, child, husband and myself... Two beds ...in a hotel room. Repeated calls to the man responsible for sed Ning out each check were unanswered... So I kept calling... Then I started calling from one cell phone and emailing... Still no response.. So I used all three cell phones and spammed his email full on order to get him to issue the first check so we could get started on rebuilding our house. He got angry and FINALLY called me back... A MONTH AFTER HE RECEIVED THE CHECK... I believe that First Franklin owes the interest on this $98,000.00 check to my family! They received interest on this money while they ignored us and left a family that just survived a house fire in a hotel room... Just wanting to get started on fixing this major problem. THEY STOLE FROM US AND LIED TO US!!!! As soon as house was rebuilt I refinanced as soon as I could!!!!!!

A girl who workes for first franklin took out a loan in my name 4000.00 dollarsand now im stuck now they are harrassing me the manager new it

i am from jena la. a girl who was supposed to be helping me helped her self.she asked if i would let her take out a persnoal loan in my name in return she would pay my loan off at century loan ive always done bussnis with them.she didnt `hold up to her end instead she took out an another 1500.00 an physically attacked me slapping me in the face.she was going to pay my loan off 400.00 now they are after me this really suxs because the manager new what was going on i went an ask to see the check an let them see it was not my wrighting she didnt wont to do that would not let me see the checks now im stuk.i hope they go under lose the whole *** company

First Franklin need to not operate as a business any form. They returned 4 months of my mortgage payments back and then forclosed my home. I tried to call them on several occassions. I was placed on hold for about 20 to 30 minutes each time. The new owner knocked on my door and had 1 month to move. Ended up going to court and their attorney walked to me and said I should not have showed for court. She had received all the paper work from First Franklin and I had none of it...so I asked her to make me a copy. All the folks that work or control First Franklin should all go to jail. So glad they had a class action lawsuit.

If any one still reads these can you email me about the class action. Im about to file one on them and need more people that have been through this with them.

They have cost me over $10,000 with their lies on closing a loan which is taken about 5 months to close.

then told me after they lied about a USDA loan that it have to go FHA and they could close it in 4 days, even have it in writing, well a month later and still nothing and oh the kicker, they love to blame it on the client not them. My email is givengarcia@***.com

Duplicate insurance payments and did not reimburse me!

I contacted First Franklin Home loan services back in July 2010 and until now and the gave me the run around until they sold my loan to BAC Home Loan service and now they are giving me the same run around about my reimbursement.I spoke with Theresa on Aug 11,2010 to see if they had receive the faxes sent provide the information of the insurance I had paid to State Farm and First Franklin was paying and out side insurance for the same home owners insurance for the fiscal years of 2007 and 2008. Consumers be aware of this.

First Franklin Loan Services is a Racketeering Influenced Corrupt Organization

First Franklin Loan Services act like gangsters and should be treated as such. Whether this is due to the lack of experience of corporate management or done at direction of corporate management, the corporation and corporate management should be held civilly liable and face criminal prosecution for the actions of First Franklin Loan Services. This is such a blatantly criminal enterprise that even the investors should be held liable for the actions of the company and corporate management. First Franklin Loan Services financed our 80/20 first and second. They have held our payments for up to 30 days for "processing" and then charged us late fees on both loans. This happened several times until we made them sign to receive their payments from the letter carrier. First Franklin Loan Services stalled our loan modification on the first and then sold the mortgage to another (better) company once it became apparent that we would get the modification. Since working with our new loan company (a PROFESSIONAL company not one run as though it were a criminal enterprise), we now have an "Obama" loan on our first mortgage. First Franklin still held the second and were being forced to match the interest rate of the first after mod so they sold it in late September 2010 to BOA. Of course, we are just the ones that signed the contract so there is no reason to inform us that they are selling the contract. After sending First Franklin Loan Services our September payment, we were billed by BOA for our September payment. Perhaps I should call them at breakfast, lunch and dinner like they did us, even when they did credit our accounts with payment after processing our payments on time. Wait, I should just start legal action and their attorneys can respond to the Court. Can you spell "PUNITIVE"?

Me and My husband too have been the victim of the First Franklin buy out and/or transfer of our loan to supposedly Bank of America who told us we had to come up with $11K to get our account back in standing which was way more than what we were behind due to my husband being layed off. Now they are saying our home was foreclosed on in October of 2010 and they own the home.

I'm so confused and we have never received a notice of actually sale on the home of them purchasing it in a foreclosure that mind you no one would call me back about and I kept being passed from FF to BOA about the foreclosure. FF would say they couldnt do anything b/c our loan was being transferred to BOA and BOA who said they couldn't do anything b/c they would not have our paperwork until after the foreclosure date.

But I have did some research and FF was a servicer for Merrill Lynch who is own by BOA. So I feel like this is all a scam with BOA and I don't know what to do at this point or if an attorney could or would even help us????

First Franklin sold my loan to Bank of America Right As my husband and I were to get out Making Homes Affordable Modification....I did everything they asked of me sent the trial payments in on time etc. Just as everything was to be finalized I received a letter in the mail saying welcome to Bank of America we are now service your home loan.

I have called them numerous times just to have them tell me they don't have all of my information yet not to mention they don't see the payments I made to FF and I was told I was 8 months behind!!!!!

WHAT ARE YOU KIDDING ME????? They only information they have to date is my account information.....I feel stuck this can't be happing!!

What is being done about these folks and their unprofessional & misleading tactics? We went through 2 years of this stuff with them, trying to get it straight.

We are currnet but have hundreds of dollars in unresolved late fees, and just as I am still certified mailing them their own documents that clearly state what they were supposed to do with our loan, I get a letter saying BOA is now my new service provider and the class action lawsuit in the same month.

I am exhausted with fighting them. They never responded when they were supposed to, we basically had to make calculations & pay more than we needed to so they wouldn't forclose, they deducted multiple payments from my bank account, sighting computer glitches and still have our credit history inaccurate, and hundreds of dollars of fees on our account-made life stressful.

After making a payment and a half for a year, of which I questioned repeatedly-we were never more than 3 months behind to begin with - they still couldn't figure it out. Now I have another loan servicing company that has no record of anything that happened, except they want the late fees paid...any helpful information would be appreciated..

We too are fed up with First Franklin Loan Services (Home Loan Services). We received forclosure notice in March 2010, that we were behind on our mortgage and we were not behind at all. I have sent cleared checks, bank statements and everything I can think of to prove that our mortgage payments were made. The crazy thing is I always paid an extra $15.00 to pay by phone and get a conformation number for my payment. They still could not process it correct.

We have been trying to make house payments since April 2010 and they will not except the payment due to us "being behind" and they informed me that when it was all taken care of and cleared up then they would accept our payments per Ron Martin in the bankruptcy department of Home Loan Services. This is the gentleman that I have to call and make my payments with.

My husband and I both were unemployed for about 6 months and we have tried on several occasions to get a Making Homes Affordable Modification, which we do qualify for. Unfortunantly they deny us and say we did not get documents in on time. Well I faxed everything and print a fax conformation and still they do not get it.....Literally THEY DONT GET IT. I PRAY THAT EVERYONE INVOLVED IN THE ACTIONS OF THIS COMPANY HAVE TO FEEL WHAT IT IS LIKE TO BE TREATED THE WAY WE HAVE BEEN TREATED.

I am a business owner and have knowlege on running a business and this is not how you do it.

Please if there is any help in this situation or if anyone can direct me somewhere to get help, I would so appreciate it. If there is anything I may do to assist anyone, please do not hesitate to contact me....

Sold our loan did not carry through with modification

First franklin has kept us waiting for 6 mo9nth for a so called loan from the loan/goverment program, now they have sold our loan and claim we are 7 months behind when in reality we are not even two months what a rip-off they can shove the hopuse where the light don,t shine. I will try to work with the new lender but it may be too late to safe our home. on my recent bill i was charged a $200.00 fee for a drive by inspection, i don't think so!!!! I will be in contact with new york banking laws

First Franklin is a bunch of ***, dont let them mislead you for months like they did us, just so they can put you in foreclosure. the attorneys general oiffice is already investigating them. get out now and seek to refinance with someone else or turn in complaints to n.,y. state banking or whatever state your in!!!! please do not be mislead bu the other compaanies that call you when you turn in a complaint against first franklin they all work together to get more money. how do you justify having to pay $225.00 for a drive by inspection?

We had our house foreclosed in Texas without proper notification from the bank, IE, We were never officially notifyed by the bank that they were going to foreclosure on our home. First Franklyn is very unprofessional and once the financial situation in my house changes I will file a law suit against them....

They want you to get foreclosed on. It seems that these scam mortgage companies put a lot of these mortgages under securitizations. The mortgage forecloses, they get an insurance payoff.

Do Not Use First Franklin

This company is a bunch of rip off artist. They will tell you everything you want to hear and then totally rip you off. They say they will refinance but won't. Then they will move around your loan and not tell you they do. My family had a automatic withdrawl payment but they said we were late. How does that happen. Oh yeah they moved our loan to one of their other compnaies, but didn't tell us about it. But still took our payment for a year before saying anything. And that was to say get out.... Said they took pictures of the notices for us to leave but will not produce them..

First franklin is a crook company. They will steal your money and your home.

They fumble paper work for months till the dead line day and then send you the paper work .

And tell you to sign today or lose your home. and its the same *** loan that gets you in trouble. Lower interest rate great . But they made the new loan look like i never made 5 years of payments..

and ended up with those 5 yrs of payments put at the end of my loan.

Making my ballance of home 30 thousand over what i agreed to pay when i bought this home .. scam artists..

Did not lower payments

I got ripped off by a property manager and almost lost my house. First Franklin said that they will re-modify my loan but the payments did not come down. Now a year later, I can't not afford the payments and have to short sell my home. They have either accept the short sell or the house will go to foreclosure. First Franklin will have to make the choice. I hope that this doesn't happen to the employees there. Times are hard now and they should take that into consideration. Especially when it is some else's fault that I am having a problem meeting the payments.

Would not assist me!

I was told that First Frankin purchased my loan. They raised my interest rate. I fell on hard times. The mortgage co. refused to work with me. This is inspite of all the bail programs and after all the modification programs, this company refused to refinance my home. I currently owe $20,000 more that what the home is worth. I have tried my hardest to work with them and they absolutely refuse to work with me. Also I have tried to work with these people. I am a single father with two children and they are not willing to help. I have worked for the past 16 years since graduating from college.

Contract Breach

First Franklin agreed to a loan modification to lower the interest rate and then turned around and jacked up the interest rate. In addition, they tried to tell us that we had to have an escrow account for future payments. For your information: This is an illegal procedure. These people are just as bad as Fairbanks Capital Corp. They should be run out of business. What a bunch of lowlife *** they are. Still another aspect of their crooked dealings is the fact that they split the mortgage loan to charge even more interest. Their reason: I have no idea and then they tried to force insurance on the loan despite the fact that we sent them a copy of the current homeowners policy.

The ability for the bank to protect its asset is clearly written out in the mortgage note. It advises that at any time the bank is notified of delinquent taxes or canceled insurance they have the right to force place them to protect their investment...that is a no brainer...let me guess you probably did not read your mortgage note and therefore dont understand and i am guessing didnt pay your taxes and were surprised to see your mort increase right!!...lol

Question: How are your comments helping anyone? If the terms of your loan are changed from their original state without your consent, that would be contrary to the truth and lending act and that in my humble opinion is illigal and a breach of contract.

I am not sure if you are really aware how a loan mod works however the terms are written out and you must agree and sign in front of a notary...if you did not read the terms i think that may be your negligence..further more a mod is not necessarily used to lower your payment( big misconception)..it is used mainly to bring your account current after a hardship..As far as the escrow is concerned escrow is a free service provided by your servicer to pay any delinquent taxes and insurance and then to keep your taxes and or insurance current ...the bank does not want to pay your taxes and insurance for you and then wait for you to pay them back. therefore when you 1st set up an escrow account the bank will have to 1st pay any delinquency you may have with taxes and insurance and also calculate what should have been in the escrow account year to date ..this is called the shortage and usually falls off after 12 months...then the bank will also have to continue to collect for future installments so when it is time to pay your taxes and insurance the bank will have the funds needed to distribute to the appropriate institution...i know that we live in frustrating times but before you pop off and start complaining about how it is illegal to do escrow for future installments perhaps you should read and understand what escrow means and how it works and the same goes for a mod...the bank is required only to collect the original note you signed and nothing else ...if you got into trouble and they modified the account you should feel lucky as it is not a requirement...i really feel the problem with america today is that we constantly get it pounded into our heads that somebody owes us something...bottom line you signed the note ...pay your mortgage ...if you can no longer afford it sale or shortsale your property...dont blame your troubles on someone else.

take ownership and move on. thats how it used to be in this country...i say less govnt hand outs and more individual ownership

I fear losing my home

It started when I first closed on my home and my loan rate increased just prior to the closing. It was hard enough that the closing on my house was pushed off over and over again and I spent a month prior to the closing date living on my friend's couch while someone babysat my cats with my stuff spread across 2 peoples garages! I don't know if the closing issue was the fault of First Franklin or not but the percentage increase... Everything was ok while I was current. The minute I got behind the harassing phone calls started, including at my job. They did not offer me any help options because the fact that I had not gotten a raise but almost ALL of my other bills had increased was not a substantial reason for getting delinquent on my mortgage! I tried working with them to reach some kind of agreement but they ALWAYS wanted these huge sums of money (2 and 3 times my monthly mortgage payment amount) prior to setting up any arrangements. Eventually I tried filing bankruptcy but to keep the house I had to file Chapter 13. My original closing payment was about $650 and had steadily increased because the first mistake was that my flood insurance premium had not been included into the escrow and then the insurance and property taxes were increased. My payment made it all the way to $806 within 18 months! During my Bankruptcy First Franklin argued that I was not making my current mortgage payment amount. Indiana had issues with the property taxes and there was a reassessment which brought my payments down to $730 or so. I tried by phone and letter to get clarification of why they thought my payment was supposed to be higher and included all the documents they sent me stating what my mortgage payment should be. They NEVER clarified why they were trying to make me pay the larger amount (even a request from my attorney went unanswered)! I dismissed my bankruptcy without completing it. After some research about the housing crisis and what mortgage companies are capable of doing to help protect people from losing their homes and because "they don't want the properties," I attempted to do a re-modification of the loan with the company on my own without an attorney. I had to fax the papers to them 3 times. During 1 conversation with someone he said there was a guy assigned to my case and I needed to call him, after i left 2 messages for this guy he left me a message that he had nothing to do with my loan and I was NEVER to call him again! I then talked to my current assigned person who is usually polite on the phone, but when she finally confirmed receipt of the papers and said they'd be reviewed and she'd called me back; I waited a week to hear from her only to call and find she'd gone on vacation and as far as I was aware my house had been up for sheriff sale in less than 2 weeks!! That problem was fixed and I was told someone would contact me, I gave her another 2 weeks because of her vacation and still heard nothing when I called again some other person told me about my arrangements and that they needed a signature from me and money in 3 days! No one had contacted me at all to tell me what needed to be done. The worst part is....yep, haven't even reached that yet...I'm currently in the middle of this pre-modification stuff, in which they want 6 payments on time BUT THEY RAISED THE PAYMENTS TO $950 PER MONTH!!!! I couldn't make the payments when they were $730 and now they have raised them over $200 more per month -- for 6 MONTHS! I'm already struggling to get the payments in there and am at my wits end on what other options I have. This whole process has damaged my credit so bad I don't even know how I would rent a place if I lost my home. There is no reason I should be paying almost $1,000 per month on a $65,000 home!!!!

Disabled Veteran about to loose his home due to this unhelpful company

I am a disabled veteran and this mortgage company said they would work with me but has not and said that I either should sell my house or I will loose it. I have a fiance and 5 children and i think First Franklin would rather see us living on the street then helping and keeping us in our home. They say they will help in hardship times. YEA RIGHT!!! They want you to come out of it before they will help. When you are a disabled veteran and do not work anymore and cant due to your injuries, that was sustained while in IRAQ, serving our great nation and keeping the people safe that work behind that desk, you think they would help, even if it was to take the 9.7% interest that I pay down to at least 6% that would help me to keep food on our table and water running to take a shower and lights on to keep our milk cold. I have never heard of a mortgage company that don't give a rats @!# about any of its people. I have a loan of $76,000 with this place and if I get to keep my home in 30 years I will have paid this dump over $279,000. All I have to say to this place is "First Franklin you are not welcome for anything and they way you treat a veteran you should take your company over seas and you would fit right in with the teariest, and for the way you treat a man that has fought for you to have your chair on wheels that you sit on every day!

First Franklin Loan Services illegally entered my home and removed my stuff

First Franklin illegally entered my home, changed the locks and removed all of my belongings. All they did was say it was a mistake and returned the new key. And then they did it again two months later. I have tried contacting them repeatedly by phone, mail, email, fax. They have ignored all communications from me and my attorney regrading the incident. This happened 8 months ago. I have not received any response from them at all. They know that this is illegal and refuse to acknowledge that it has happened. What should I do to get this situation rectified?

Anyone that deals with these jerks...just be ware yes due to them and the dumb a....they have working there...We too are in foreclosure with a 3 year old and husband in bad health...compassion? I don't think so! We tried the modification, and all other "SERVICES" they offered. So Sad now we live in a house built in 1894 with holes, no heat but wood stove....stirafoam on the walls...hope they go to...................I can not understand their thinking and how to get our home back. Its been a cold winter for all of us.

First franklin holds my mortage,they made a mistake and did not calculate my escrow correctly and it ended up putting me $4000 in the hole instead of helping with their mistake they instead charged me and raised my mortage by $600 more a month. When i put in for a hardship they kept losing the paperwork it took them more than 3 months just to tell me they can not help me at all.
